Which license a café, shop or hotel needs
Playing music in a shop or restaurant is public performance under the Law on Copyright and Related Rights No. 2811 IX. Registered societies such as ULASP, OKUASP and UACRR offer a contract for the use of works and recordings, for the music in their own catalogue.
The Ministry of Economy register of 4 May 2026 lists 19 registered societies and none with accreditation. ULASP was accredited for recordings remuneration in 2019 for three years, and OKUASP's accreditation for musical works lapsed on 13 February 2022. Under martial law no accreditation contests are held.
How the fee is worked out
While no society is accredited, societies license their own catalogues at tariffs they set themselves. Under the martial law rules the recordings remuneration is 50% of the fee paid for the musical work. Once a society is accredited again, recordings tariffs are agreed in negotiations run by the state body or set by a court and bind all users of that category.
Historical example: the ULASP recordings tariff of 2019 for cafés, bars and restaurants is seats x UAH 40 x a coefficient from 0.4 to 1 per month, with terrace seats at UAH 20; shops are charged by category and floor area. It was set while ULASP was accredited, and current prices were not verified for this guide.
Can I play Spotify or YouTube in my business?
Consumer plans of Spotify, Apple Music and YouTube are licensed for personal, noncommercial use under their own terms, so a private account is not a license to play music to customers. ULASP's FAQ says Apple Music, Spotify and similar subscriptions grant only personal use, and playing them in a shop or restaurant is public performance that needs a license.
Music outside the collecting societies
Law No. 2415 VIII makes public performance of musical works and the recordings remuneration fields of extended collective management (article 12(5)). An accredited society in these fields would cover non members too, unless they opt out in writing (article 13). Public performance is not under mandatory collective management.
Because no society is accredited today, societies may license only works in their own catalogue, and their martial law power to collect recordings remuneration is limited to recordings of those works. Music whose authors, performers and producers are not in any society and which is licensed directly gives no society a legal basis to charge. ULASP's FAQ also says no royalty is due when musicians perform their own compositions.
Caveats: performers and producers have a statutory right to remuneration for public performance that cannot be transferred (Law No. 2811 IX, articles 38 and 39), so the direct license should settle it. Once accreditation contests resume after martial law, an accredited society will again cover non members unless they opt out. Courts can award compensation of 2 to 200 subsistence minimums or double the license fee, triple if intentional (article 55).
Dr.DIO in Ukraine
Dr.DIO Studio makes its own electronic and ambient music, no Dr.DIO track is registered with any collecting society, and the Business plan ($14.99 a month per venue, 14 days free) gives the venue a direct public playback license and a certificate for Dr.DIO music.
In 2026 no Ukrainian society is accredited and none manages Dr.DIO music, so no society has a legal basis to charge a venue that plays only Dr.DIO music under its direct license. Keep the certificate and the track list, since societies document venues by video and track identification.
This can change when accreditation contests resume after martial law: an accredited society would then cover non members unless they opt out in writing. If that happens, ask the accredited society in writing, with the Dr.DIO certificate, before you rely on paying nothing.
Any other music in the venue, such as radio, TV, live music or other playlists, still needs the usual licenses.
